Anyone paid for a post, or benefiting from it in some other way, is advertising — and advertising should be recognisable as such before anyone reads it.

It is not only the paid post that gets labelled. A consideration without money counts too — a product sample that may be kept, a trip, a discount. So do links that earn you something. The rule of thumb: as soon as a benefit is involved that could influence what is said, it belongs in the open, and clearly at the start rather than hidden among the hashtags.

An entry that earns you something is marked as an affiliate link in the creator area; the bio page then shows it as advertising for everyone to see. Under the creator agreement this marking is mandatory — setting it takes one click, and forgetting it falls back on the person showing the link.

How a post is labelled follows the applicable rules and the requirements of the platform it appears on — Instagram, TikTok and YouTube each have tools of their own for it. The responsibility lies with the creator. An instruction from a brand to leave the disclosure out carries no weight: nobody has to follow it, and it must not be followed either.
